Introduction
This Privacy Policy and Cookie Notice explain how Publicis S.r.l. ("Company", "we", "us") processes and protects personal data collected through the Dark Mode Ads platform ("Platform"), pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 ("GDPR").
This notice applies to:
- Registered users (business accounts/advertisers) who access the Platform after registration and verification.
- Visitors who access the public landing page for informational purposes.

Please note that, under the Terms of Use, images uploaded to the Platform must not include any identifiable person.
I. Purposes of Personal Data Processing
We process personal data to:
- Respond to requests sent through the contact channels indicated on the Platform.
- Maintain and preserve the security of the Platform and registered user accounts.
- Register business users, enable access, and provide requested services (including upload of ad creatives, AI transformation, generation of Dark Mode outputs, and download of generated files).
II. Categories of Personal Data We Process
Depending on your interaction with the Platform, we may process:
- Communications Data: content of messages and requests sent to us.
- Technical Data: browsing information such as IP address, user agent, and usage of Platform pages/areas.
- Registration Data (business users): full name, work email address, password (stored in hashed form), and role.
- Platform Usage Data (business users): login timestamps, session data, and account-related events.
Users are reminded that AI-generated or AI-processed images on the Platform must not include personal data or images that identify an individual.
III. Legal Bases for Processing
We process personal data on the following legal bases:
- Pre-contractual measures: handling information/commercial requests about the Platform.
- Performance of a contract: account registration and use of Platform functionalities.
- Legitimate interest: Platform/account security, fraud prevention, and legal defense.
- Performance of a contract: use of technical cookies and system observability needed to operate the Platform.
- Legal obligation: handling requests related to data subject rights.
Mandatory form fields are required to process requests. If such data is not provided, we may not be able to respond.
IV. Data Sharing
Personal data may be accessed by authorized technical personnel for maintenance and support.
We do not disclose personal data to third parties except where necessary, including:
- Corporate transactions (e.g., merger, acquisition, transfer of assets).
- Establishment, exercise, or defense of legal claims.

VI. Data Retention
- Registration data and technical data: retained for the account lifetime.
- After account deletion: associated data (chats, inputs, outputs, images) is permanently deleted.
- Session data (IP address and user agent): retained for 7 days.
- Invitation and password reset tokens: retained for 30 days.
VII. Data Security
We implement technical and organizational security measures (including firewalls, intrusion detection tools, and internal procedures) to protect data integrity, confidentiality, and availability.

VIII. International Data Transfers
Primary personal data (accounts, sessions, chats, uploaded/generated images) is stored in the EU/EEA.
